The Man Wins Again As Court Dismisses Fucked Up's Lawsuit

A three-judge panel in California has dismissed a lawsuit brought by a host of indie rockers, including Xiu Xiu and Fucked Up, against Rolling Stone magazine. At issue was a four-page gatefold section of the magazine that showed "The Indie Rock Universe." The bands charged that Rolling Stone really wanted to sell advertising space to R.J. Reynolds, and that including the company's ads in the section unfairly associated the bands with smoking. Not so, say the judges, who ruled that noncommercial speech doesn't lose its First Amendment rights even when it occurs near advertising. The bands involved in the lawsuit have yet to comment on the ruling. [The Daily Swarm]
