We've covered Kazaa's payout to the record industry on account of, well, their enabling of massive piracy. In a litigation move that can only be described as sheer brilliance, one David Gruebel argues that because the labels have already collected against Kazaa, he cannot be collected from on account of copyright infringement.
My legal expertise is insufficient to make a call on how effective this electronic Twinkie defense will be, but if it holds up, one could say the music industry has funded Kazaa as a free buffet for users to consume as they please. Mouth watering.
