Janet Jackson’s nipple just won’t go away. The federal appeals court ruled that the accidental exposure of her right breast during the halftime show at the 2004 Super Bowl wasn’t indecent, throwing out a $550,000 fine against CBS Corp in July 2008. Now, the U.S. Supreme Court is involved, ordering a lower court to reconsider the fine against CBS.
The federal appeals court in Philadelphia will now reopen the case, and will presumably scrutinize Jackson’s nipple in even greater detail. The infamous “wardrobe malfunction” has already cost CBS a fine of $27,500 to each of its 20 owned-and-operated stations, and the corporation now runs live sporting events with a five-second delay in case any further incidents occur.
A spokesperson for CBS reasonably stated they are confident that the appeals court "will again recognize that the Super Bowl incident, while inappropriate and regrettable, was not and could not have been anticipated by CBS.” You can relive the moment, and hope that your moral standards aren’t shredded in the process, on this YouTube clip.
