Eminem's Lawsuit Over Royalties May Affect Many Artists

Two years ago, Eminem filed a lawsuit against his record label, Universal, over royalties related to his music's sale on iTunes. Em sued, saying he should be entitled to a larger profit when his music is sold on iTunes, as he is only receiving less than 20 cents of a 99 cent download.

 

Eminem's lawsuit is set to go to trial today, as the jury has already been selected. The case could have huge implications for other musicians, and for the price of MP3s on iTunes if Eminem wins, since it will open the door for other artists to challenge for a bigger piece of MP3 sales and might cause labels to demand iTunes to sell songs for more than 99 cents so that the label can keep its profits up. 

 

At debate in the case is whether or not MP3s are considered under a typical artist-label royalty share, which is usually 50-50 in CD sales, but is considerably less in MP3 sales. Universal is claiming they are giving Eminem his fair share after they have to pay off third party licensing companies to put his music on iTunes, but Eminem says that's not the case.
